1. Acceptance of Terms
By accessing or using BiteCast, you agree to these Terms & Conditions. If you are agreeing on behalf of a business, you confirm you have the authority to bind that business.
You must be 18 or older and legally able to operate a business in Pakistan.
2. Services
BiteCast provides:
- AI-powered WhatsApp ordering bot
- Multi-branch point-of-sale (POS) and kitchen display
- White-label online storefront and custom domain
- Menu, order and branch management
- Delivery management, rider app and delivery zones
- Reservations, waitlist and table management
- Customer records, loyalty programmes and coupons
- Analytics, reports and AI insights
BiteCast is a software provider only. We do not operate restaurants, employ your staff, cook food, or deliver orders.
We take no commission on your orders. You pay a subscription fee — every rupee your customers spend is yours.
3. Account Responsibility
You agree to:
- Provide accurate information and keep it current
- Maintain the security of your account
- Be responsible for all activity under your account, including by your staff
- Notify us immediately of any unauthorised access
One account per restaurant business. Do not resell or share access.
4. Subscription & Payments
- Plans are billed monthly, quarterly, half-yearly or annually. Longer terms carry a discount, shown before you commit.
- Subscriptions renew automatically unless cancelled before the period ends.
- All fees are non-refundable unless required by law.
- Prices may change with 30 days' notice. A change never applies to a term you have already paid for.
- Failure to pay may result in suspension. Your data is retained for 30 days after suspension so you can recover it.
- You may cancel any time and keep access until the end of the period you paid for.
- Applicable taxes are your responsibility.
5. Customer Payments
You may connect JazzCash, EasyPaisa or other supported gateways. When you do:
- Your relationship for those payments is with the gateway, under their terms — not with us.
- Money from your customers goes directly to you. BiteCast never holds your funds.
- Refunds, chargebacks and customer disputes are yours to handle.
- Keeping your gateway credentials secure is your responsibility.
We never store card numbers. Only a transaction reference and a paid/failed status.
6. Data & Ownership
You own your data. Your menu, your orders, your customer records — they are yours. We process them on your behalf so the software can work.
For your customers' personal data, you are the data controller and BiteCast is the processor. That means:
- You are responsible for having a lawful basis to collect and use it
- You must obtain marketing consent before sending marketing messages — the platform records consent per channel, so use it
- You must honour your customers' requests to access or delete their data. We give you the tools
- We will never use your customers' data for our own purposes, and we never sell it
You can export your data at any time. On cancellation you have 30 days to export before deletion.
7. Acceptable Use
You agree NOT to:
- Use the system for illegal purposes or violate local laws
- Send spam or message people who have not consented
- Violate WhatsApp or Meta policies
- Misuse customer data
- Attempt to access another restaurant's data
- Upload malware, or probe, breach or overload our systems
- Reverse-engineer, copy or resell the software
- Misrepresent your business or your food
Violation may result in immediate suspension or termination.
8. WhatsApp & Meta Disclaimer
BiteCast is not affiliated with WhatsApp or Meta Platforms, Inc.
You are responsible for complying with WhatsApp's policies. If a WhatsApp number is banned due to misuse, BiteCast is not liable.
9. Restaurant Responsibility
Restaurants are solely responsible for:
- Food quality, hygiene and safety
- Pricing accuracy
- Order fulfilment and delivery
- Customer disputes and refunds
- Their own staff and riders
BiteCast provides software infrastructure only.
10. Service Availability
We aim for 99.9% uptime but do not guarantee uninterrupted service on standard plans. We may take the platform down for maintenance and will give notice where we reasonably can.
Enterprise customers may have a separate service-level agreement, which takes precedence over this section.
11. Limitation of Liability
The platform is provided "as is". To the fullest extent the law allows, BiteCast shall not be liable for:
- Business losses or loss of revenue
- Lost data, or indirect or consequential damages
- Service interruption beyond our control
- The acts of third parties — payment gateways, WhatsApp, your riders or your staff
- The food you serve, or anything arising from it
Our total liability in any 12-month period is capped at the fees you paid us in that period. Nothing here excludes liability that cannot lawfully be excluded.
12. Termination
We may suspend or terminate accounts for:
- Non-payment
- Fraudulent activity
- Violation of these Terms
You may cancel any time from your account settings. On termination, your data is retained for 30 days for export, then deleted.
13. Changes to Terms
We may update these Terms. For material changes we give 30 days' notice by email. Continuing to use BiteCast after that means you accept the new terms. If you do not, you may cancel.
14. Governing Law
These Terms are governed by the applicable laws of Pakistan. Any disputes shall be subject to the jurisdiction of the courts of Karachi, Sindh.
